| dc.description | El propósito de este trabajo es comparar las lógicas de legitimación del Imperio como Estado Laico en la teoría política de Marsilio de Padua y de Guillermo de Ockham a partir del caso de anulación matrimonial de Margarita Maultasch. En el rol de consejeros de Luis de Baviera, ambos religiosos elaboran un documento en el que explican las razones por las cuales la autoridad eclesiástica no tiene jurisdicción para impedir que el Emperador anule el lazo matrimonial entre Margarita de Tirol y Juan Enrique de Bohemia. Los motivos alegados por el Emperador Luis de Baviera (impotencia y consanguinidad) para dictaminar la anulación del matrimonio de la Duquesa de Tirol despiertan un gran debate en torno a la jurisdicción eclesiástica y civil para tratar el caso. El tema es tratado por Marsilio en forma distinta a la respuesta que ofrece Ockham, aunque ambos llegan a la misma conclusión. El contraste entre la teoría del paduano y del doctor invencible muestra enfoques muy distintos en relación a la legitimidad del poder. | - |
| dc.description | The purpose of this paper is to compare the logic of legitimation of Empire and the Secular State in the political theory of Marsiglio of Padua and William of Ockham from the case of marriage annulment Maultasch Margarita. In the role of counselors Louis of Bavaria, both religious produced a document explaining the reasons why the ecclesiastical authority has no jurisdiction to prevent the Emperor annul the marriage bond between Margaret of Tyrol and John Henry of Bohemia. The reasons given by the Emperor Louis of Bavaria (impotence and blood) to rule the annulment of the marriage of the Duchess of Tyrol arouse great debate over the ecclesiastical and civil jurisdiction to try the case. The subject is treated differently by Marsilio response to Ockham offers, although both come to the same conclusion. The contrast between Marsiglio and Ockham´s theory shows very different approaches regarding the legitimacy of power. | - |
